Section 1-25. Police Department, Appointments.
- There shall be a Police Department, the head of which shall be the Chief of Police, and who shall reside within 10 miles of the Town of Tryon. Pursuant to Title 11, Section 12-111 of the Oklahoma Statutes, the Board of Trustees may appoint the Police Chief and may remove him, the Chief of Police serving at the pleasure of the Board of Trustees.
- Pursuant to Title 11, Section 12-111 of the Oklahoma Statutes, the Chief of Police may appoint such police officers as he may deem necessary, such appointments to be subject to the approval and confirmation of the Board of Trustees. Such police offices as may be appointed may be removed by the Police Chief with confirmation of the Board of Trustees, or may be removed by the Board of Trustees.
- The Chief of Police shall have supervision and control of the Police Department, subject to the supervision of the Board of Trustees.
Section 1-26. Police Department: Duties.
- The Chief of Police is a Police Officer and shall have the powers and liabilities of sheriffs in executing orders of the Board of Trustees and enforcing the ordinances of the Town, as provided by Title 11, Section 34-102 of the Oklahoma Statutes.
- It shall be the duty of the Police Department to apprehend and arrest on view or on warrant and bring to justice all violators of the ordinances of the Town; to suppress all fights, affrays, and unlawful assemblies which may come to their knowledge and generally to keep the peace; to serve all warranties, writs, executions, and other processes properly directed and delivered to them: to apprehend and arrest persons violating federal or state law as provided by law, and to turn them over to proper authorities and in all respects to perform all duties pertaining to the offices of Police Officers.
Section 1-27. Police Department; Deputies And Policeman: Educational Requirements.
- No person shall receive a permanent appointment as a police officer within the Town of Tryon unless:
- He has undergone evaluation similar to the Minnesota Multi-Phasic Personality Inventory or its equivalent as determined by the Council of Law Enforcement Education and Training; and
- He has been awarded a certificate, attesting to his satisfactory completion of a basic police course of accredited instruction from the Council for Law Enforcement Education as Required by Title 70, Section 3311 of the Oklahoma Statutes, or a curriculum of courses of study approved by the Council for Law Enforcement Education and Training.
- Every person who is not the holder of such certificate, and is duly appointed as a police officer, and shall appointed to such position on a temporary basis only and shall, within one (1) year from the date of appointment qualify as required in subsection (A) for forfeit such positions. Elected sheriffs and their deputies, and elected and appointed chiefs of police shall meet the requirements of subsection (A) within the first twelve (12) months after assuming the duties of the office to which they are elected or appointed.
Section 1-28. Police Reserve.
- A municipal police reserve is hereby created to assist the regular Police Department in the event of an emergency or disaster or at other times as deemed necessary or as directed by the Chief of Police.
- All members of the municipal police reserve shall be residents within the Town of Tryon and will be subject to the policies, rules and regulations established by the police by the board of Trustees of the Town of Tryon.
- The Board of Trustees may make and publish such additional rules and regulations consistent with this article as may be necessary for the implementation of a municipal police reserve.
Section 1-29. Appointment Of Police Reserve Officers.
- Reserve Municipal Police Officers shall be appointed by the chief of Police, with the approval and confirmation of the Board of Trustees and shall, prior to appointment to the municipal police reserve, have a complete background inquiry of the applicant conducted by the Police Department. The applicant shall be personally interviewed by the Chief of Police and the applicant’s photograph and fingerprints shall be obtained.
- Each applicant shall be interviewed as to his ability to safely handle firearms and shall submit to a physical examination at the applicant’s expense to determine fitness to perform assigned duties.
- No person shall be eligible for appointment to the municipal police reserve who shall be a member of any other law enforcement reserve force, whether it be municipal, stat or other reserve force, or who has been convicted of a felony under the laws of the State of Oklahoma, or of any other state of the United States, or any offense involving moral turpitude nor shall any such person be eligible to continue to serve as a member of the Tryon Municipal Police Reserve who has been convicted of felony under the laws of the State of Oklahoma, or of any other state of the United States or any offense involving moral turpitude. It shall be the duty of the Chief of Police to refuse such appointment to all persons under the age of twenty-one (21), drug addicts, habitual drunkards and such other persons as he has reasonable cause to believe are not qualified.
Section 1-30. Status Of Police Reserve Member.
- The duly appointed members of the police reserve shall be on a probationary status for 4 minimum of one (1) year from the date of their appointment after which time the Chief of Police may commission them as permanent reserve police officers. Members of the police reserve shall Serve at the pleasure of the Board of Trustees and upon termination, for any reason, shall have no appeal rights, and no access to the review provisions of the personnel policy for the Town of Tryon.
- Police reserve members shall be required to comply with all rules and regulations promulgated by the Oklahoma Council on Law Enforcement Education and Training, as provided for in Title 70, Section 3311 of the Oklahoma Statutes, as amended.
Section 1-31. Compensation And Uniforms.
- Police reserve members may be compensated pursuant to policies, rules and regulations established by the police reserve as approved by the Board of Trustees.
- Police reserve members may be furnished uniforms as prescribed by the Chief of Police and shall wear uniforms and shall carry weapons only when on duty assignments as designated by the Chief of Police.
