Traffic – Article 05. Driving on Right Side of Road

Section 13-32. Drive on Right side of Roadway: Exceptions.

  1. Upon all roadways of sufficient width, a vehicle shall be driven upon the right half of the roadway except as follows:
    1. When overtaking and passing another vehicle proceeding in the same direction under the rules governing such movement.
    2. When the right half of the road is closed to traffic while under construction or repair.
    3. Upon a roadway divided into three marked lanes for traffic under the rules applicable thereon.
    4. Upon a roadway designated and signposted for one-way traffic.
  2. Upon all roadways, any vehicle proceeding at less than the normal speed of traffic at the time and place, and under the conditions then existing, shall be driven in the right-hand lane then available for traffic, or as close as practicable to the right-hand curb or edge of the roadway, except when overtaking and passing another vehicle proceeding in the same direction or when preparing for a left turn at an intersection or into a private road or driveway.

Section 13-33. Passing Vehicles Proceeding in Opposite Directions.

Drivers of vehicles proceeding in opposite directions shall pass each other to the right; and upon roadways having width for not more than one (1) line of traffic in each direction, each driver shall give to the other at least one-half of the main-traveled portion of the roadway as nearly as possible.

Section 13-34. Overtaking a Vehicle on the Left.

The following rules shall govern the overtaking and passing of vehicles proceeding in the same direction subject to those limitations, exceptions and special rules hereinafter stated:

  1. The driver of a vehicle overtaking another vehicle proceeding in the same direction shall pass to the left thereof at a safe distance and shall not again drive to the right side of the roadway until safely clear of the overtaken vehicle.
  2. Except when overtaking and passing on the right is permitted, the driver of an overtaken vehicle shall give way to the right in favor of the overtaking vehicle on audible signal and shall not increase the speed of his vehicle until completely passed by the overtaking vehicle.
  3. Every driver who intends to pass another vehicle proceeding in the same direction, which requires moving his vehicle from one (1) lane of traffic to another, shall first see that such movement can be made with safety and shall proceed to pass only after giving a proper signal by hand or mechanical device.

Section 13-35. When overtaking on the Right is Permitted.

  1. The driver of a vehicle may overtake and pass upon the right of another vehicle only under the following conditions:
    1. When a vehicle overtaken is making or about to make a left-hand turn.
    2. Upon a street or highway with unobstructed pavement not occupied by a parked vehicle of sufficient width for two or more lines of moving vehicles.
  2. The driver of a vehicle may overtake and pass another vehicle upon the right only under conditions permitting such movements in safety. In no event shall such movement be made by driving off the pavement or main-traveled portion of the roadway.

Section 13-36. Further Limitations on Driving to Left of Center of Roadway.

  1. No vehicle shall at any time be driven to the left side of the roadway under the following conditions:
    1. When approaching the crest of a grade or upon a curve in the highway where the driver’s view is obstructed within such distance as to create a hazard in the event another vehicle might approach from the opposite direction.
    2. When approaching within one hundred (100) feet of or traversing any intersection or railroad grade crossing.
    3. When the view is obstructed upon approaching within one hundred (100) feet of any bridge, viaduct, or tunnel.
  2. The foregoing limitations shall not apply upon a one-way roadway.

Section 13-37. No-Passing Zones.

  1. The Oklahoma Department of Highways as regards state and federal highways, and the Town of Tryon as regards all other streets, are hereby authorized to determine those portions of a highway where overtaking and passing or driving to the left of the roadway would be especially hazardous, and may by appropriate signs or markings on the roadway have the beginning and end of such zones indicated; and when such signs or markings are in place and clearly visible to an ordinarily observant person, every driver of a vehicle shall obey the directions thereof.
  2. Where signs or markings are in place to define a no-passing zone as set forth in paragraph (a), no driver shall at any time drive to the left side of the roadway within such no-passing zone or on the left side of pavement striping designed to mark such no-passing zone throughout its length.

Section 13-38. Driving on Roadways Lane for Traffic.

Whenever any roadway has been divided into two (2) or more clearly marked lanes for traffic, the following rules in addition to all others consistent herewith shall apply:

  1. A vehicle shall be driven as nearly as practicable entirely within a single lane, and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety.
  2. Upon a roadway which is divided into three (3) lanes or more, it shall be a violation for any vehicle to be driven in any center lane, or in any lane marked and designated exclusively as a turn lane except when in direct preparation for a turn from the said traffic lane.

Section 13-39. Following too closely.

The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicles and the traffic upon the condition of the highway.
