Article 2. Administration

Section 13-2. Police Administration.

There is hereby established an administrative department entitled the Police Department. The Police Department shall consist of the Chief of Police and such number of patrolmen as may be provided for.

Section 13-3. Driver’s Files to be maintained.

The Police Department shall maintain a suitable record of all traffic accidents, warnings, arrests, convictions, and complaints reported for each driver, which shall be filed alphabetically under the name of the driver concerned.

Section 13-4. Duty of Police Department and Fire Department.

  1. If shall be the duty of the Police Department to enforce the street traffic regulations of this Town and all of the state vehicle laws applicable to street traffic in this Town, to make arrests for traffic violations, to investigate accidents, and to cooperate with other officers of the Town in the administration of the traffic laws and in developing ways and means to improve traffic conditions, and to carry out those duties specially imposed upon said department by this Chapter and any other traffic ordinances of the Town of Tryon, Oklahoma.
  2. Officers of the Police Department or such officers as are assigned by the Chief of Police are hereby authorized to direct all traffic by voice, hand, or signal in conformance with traffic laws and ordinances; provided that, in the event of a fire or other emergency or to expedite traffic or to safeguard pedestrians, officers of the Police Department may direct traffic as conditions may require notwithstanding the provisions of the traffic laws and ordinances.
  3. Officers of the Fire Department, when at the scene of a fire, may direct or assist the police in directing traffic there at, or in the immediate vicinity.

Section 13-5. Required Obedience to traffic ordinances Police Department and Fire Department.

  1. It is a misdemeanor for any person to do any act forbidden or fail to perform any act required in this Chapter.
  2. No person shall willfully fail or refuse to comply with any lawful order or direction of a Police Officer or Fire Department Official.

Section 13-6. Emergency and Experimental Regulations.

The Board of Trustees is hereby empowered to make regulations necessary to make effective the provisions of the traffic ordinances of this Town and to make and enforce temporary or experimental regulations to cover emergencies or special conditions. No such temporary or experimental regulations shall remain in effect for more than ninety (90) days.

Section 13-7. Persons propelling push carts, riding animals, or driving animal-drawn vehicles to obey traffic regulations.

Every person propelling any pushcart or riding any animal upon a roadway, and every person driving any animal-drawn vehicle shall be subject to the provisions of this Chapter applicable to the driver of any vehicle, except those provisions of this Chapter which by their very nature can have no application.

Section 13-8. Coasters, roller skates, skateboards, and similar devices are prohibited.

  1. No person upon roller skates, or riding in or by means of a coaster, toy vehicle, go-cart, golf cart, or similar device, shall go upon any roadway except while crossing a street on a crosswalk; and when so crossing, such person shall be granted all of the rights and shall be subject to all of the duties applicable to pedestrians. This Section shall not apply upon any street while set aside as a play street as authorized by ordinances of the Town of Tryon.
  2. No person shall ride any skateboard or similar device and go upon any roadway; public thoroughfare or traffic way within the Town of Tryon.
  3. No person riding upon any skateboard or similar vehicle shall attach the same or himself to any vehicle upon a roadway.
  4. No person shall ride any skateboard or similar device upon a sidewalk within a business district within the Town of Tryon.

Section 13-9. Public officers and employees to obey traffic regulations.

The provisions of this Chapter shall apply to the driver of any vehicle owned by or used in the service of the United States Government, any state, county, town, or other governmental unit or agency, as well as to other vehicles of this Chapter, except as otherwise permitted in this Chapter or by state statute; provided that this Chapter shall not apply to the military forces of the United States and organizations of the National Guard when performing any military duty.

Section 13-10. Person working on streets, exceptions.

Unless specifically made applicable, the provisions of this Chapter, except those relating to reckless driving and driving while intoxicated, shall not apply to persons, teams, motor vehicles, and other equipment while actually engaged in the construction, maintenance, or repair of public utilities; provided that all highway and public utility operations shall be protected by adequate warning signs, signals, devices, or flagmen; but the provisions of this Chapter shall apply to such persons and vehicles when traveling to or from such work.

Section 13-11. Maintenance and Construction Zones

  1. The Town of Tryon is hereby authorized to close any highway, street, avenue, public thoroughfare, or section thereof within its respective jurisdiction to traffic while such highway, street, avenue, or public thoroughfare is under repair, maintenance or construction and, in exercising such authority shall erect or cause to be erected control devices and barricades to warn and notify the public that said highway, street, avenue, or public thoroughfare has been closed to traffic.
  2. When any highway, street, avenue, or public thoroughfare has been closed to traffic under the provisions of paragraph (A) and traffic control devices or barricades have been erected, it shall be unlawful for any person to drive any vehicle through, under, over, or around such traffic control devices or barricades, or otherwise to enter any closed area; except that the provisions of this paragraph shall not apply to persons while engaged in the construction, maintenance, and repair of said highway, street, avenue, or public thoroughfare or the persons entering therein for the protection of lives or property; and provided further that persons having their places of residence or places of business, may then travel, when possible to do so, through such area at their own risk.

Section 13-12. Authorized Emergency Vehicles

  1. The driver of any authorized vehicle, when responding to an emergency call or when in the pursuit of an actual or suspected violator of the law or ordinance or when responding to but not upon returning from a fire alarm, may exercise the privileges set forth in this Section, but subject to the conditions herein stated.
  2. The driver of an authorized emergency vehicle may:
    1. Park or stand, irrespective of the provisions of this Chapter;
    2. Proceed past a red or stop signal or stop sign, but only after slowing down as may be necessary for safe operation;
    3. Exceed the maximum speed limits so long as he does not endanger life or property;
    4. Disregard regulations governing the direction of movement or turning in specific directions.
  3. The exemptions herein granted to an authorized emergency vehicle shall apply only when the driver of any said vehicle is making use of audible and visual signals as required by law, except that an authorized emergency vehicle operated as a police vehicle need not be equipped with or display a red light visible from in front of the vehicle.
  4. The foregoing provisions shall not relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons, nor shall such provisions protect the driver from the consequences of his reckless disregard for the safety of others.

Section 13-13. Operation of Vehicles on Approach of Authorized Emergency Vehicles

  1. Upon the immediate approach of an authorized emergency vehicle making use of audible and visual signals meeting the requirements of the laws of this state, or of a police vehicle properly and lawfully making use of an audible signal only, the driver of every other vehicle shall yield the right of way and shall immediately drive to a position parallel to, and as close as possible to, the right-hand edge or curb of the roadway clear of any intersection, and shall stop and remain in such position until the authorized emergency vehicle has passed, except when otherwise directed by a Police Officer.
  2. This Section shall not operate to relieve the driver of an authorized emergency vehicle from the duty to drive with due regard for the safety of all persons using the highway.

Section 13-14. Report of Accident

The driver of a vehicle involved in an accident which occurs upon public property, and which results in injury to or death of any person or property damage to one vehicle or other property in excess of three hundred dollars ($300.00) shall immediately, by the quickest means of communication, give notice of such accident to the Police Department if such accident occurs within this city, and drivers of such vehicles shall remain at the scene of the accident until the investigation is completed by an officer or officers of the Police Department, except drivers of such vehicles who are injured may be moved immediately for medical treatment.

Section 13-15. Duty to Give Information and Aid

The driver of any vehicle involved in an accident resulting in injury to or death of any person, or damage to any vehicle which is driven or attended by any person shall give his correct name, address, and registration number of the vehicle he is driving, and shall upon request, and if available, exhibit his operator’s or chauffeur’s license to the person struck or the driver, or any person attending any vehicle collided with, and shall render to any person injured in such accident any reasonable assistance, including the carrying or the making of arrangements for the carrying, of such person to a physician, surgeon, or hospital for medical or surgical treatment, if requested by the injured person; and if the vehicle is unattended, he shall leave his correct name, address, and registration number of the vehicle he is driving in the front seat or upon the vehicle so struck and damaged.
