Section 6-4. Department Heads to Purchase: Prior Approval by Commission.
- Subject to the provisions of this Section that each department head or some other person or persons duly authorized by him. Shall contract for and purchase or issue purchase authorization for all supplies, materials, and equipment for the offices, departments, and agencies of the town government; provided that any single purchases for a price exceeding five hundred dollars ($500.00) shall not be made until specifically approved by the Board of Trustees of the Town of Tryon.
- Any department head, or his duly authorized representative, is hereby authorized and empowered for purposes of Section (A) of this Article to make use of and to avail themselves of the provisions of the Oklahoma Central Purchasing Contracts and the services of its purchasing director.
- For purposes of this Section 6-4 members of the Board of Trustees or any other elected officer of the Town shall not be considered to be a department head. Any member of the Board of Trustees or any elected office of the Town shall not make a purchase of any amount until specifically approved by the Board of Trustees.
- All contracts pertaining to public improvements, maintenance of public property, public purchase of supplies, and all other contras whatsoever character, involving an outlay as much as twelve thousand five hundred dollars ($12,500.00) or such number as may be enacted and authorized by the State of Oklahoma pursuant to the provisions of Title 61, Section 1 of the Oklahoma Statutes, shall be made by the Board of Trustees and shall be based upon the specifications provided by said Board. All such contracts shall be let and awarded to the lowest responsible bidder, by free and open competitive bidding after solicitation for sealed bids, and no work shall be commenced until a written contract is executed.
- Contracts for construction, labor, equipment, material, or repairs in excess of twelve thousand five hundred dollars ($12,500.00) shall be awarded by the Tryon Public Works Authority published in the manner provided in Title 60, Section 176, of the Oklahoma Statutes. Provided, however, should the Trustees of the Tryon Public Works Authority find that an immediate emergency exists, which findings shall be entered in the journal of the trust proceedings, by reason of which an immediate outlay of trust funds in an amount exceeding twelve thousand five hundred dollars ($12,500.00) is necessary in order to avoid loss of life, substantial damage to property, or damage to the public peace or safety, then such contracts may be made and entered in to without public notice or competitive bids; provided that the provisions of this subsection shall not apply to contracts of industrial and cultural trusts.
Section 6-5. To Contract Local Vendors: Exception: Lowest Bid.
Except in cases of emergency, any department head shall contract by mail, phone, or in person local proprietors of businesses operating in Tryon and vicinity who may be interested in furnishing the supplies, materials and equipment needed by the town, and shall use his best efforts to secure on behalf of the Town the lowest and best bid obtainable therefore.
